The Apiary Terms of Use Agreement and Waiver of Liability

This Terms of Use Agreement is entered into between The Apiary, Hormetic Healing LLC, and the guest (including any minors)

1. Reservation and Payment:

    - Payment is required in full to hold reservation unless otherwise agreed upon.

    - Stays limited to 6 consecutive days unless prior arrangement made.

2. Cancellation Policy:

   - Guests must adhere to the cancellation policy.

   - Receive a 100% free cancellation on hostel bookings up to 7 days prior to check-in   

      date. If cancelled within 7 days of check-in and we are able to rebook the room you will not      

      be held responsible.

   - Refunds, if applicable, will be issued according to the cancellation policy.

3. Check-in and Check-out:

   - Check-in time is 3 pm and no later than 10 pm for the bunk room hostel guests.

   - Check-out is 11am. Late check-out may incur additional charges.

4. Conduct:

   - Guests are expected to conduct themselves in a respectful and responsible manner.

   - Disruptive behavior, including but not limited to excessive noise, will not be tolerated.

   - Respectfully limit states of undress to bunk rooms and bathrooms.

   - Children may not be left unsupervised.

   - Service animals only by prior approval and only in private rooms.

5. Smoking and Substance Use:

   - Smoking is prohibited in all indoor areas. Designated smoking area is at the fire pit.

   - To ensure safety and an honorable use of The Apiary, guests are prohibited from using    

      recreational drugs or alcohol on the premises.

6. Property Damage:

   - Guests are responsible for any damage caused to the property and its contents.

   - Charges for damages will be assessed and billed accordingly.

7. Liability:

   - The Apiary and it’s staff are not medical providers The Apiary does however offer amenities that can have consequential outcomes to health if not used properly and    under the supervision of a physician. Guests should consult their physician before participating in sauna, hot tub, or any other practices offered by retreat providers to ensure the practice is not contraindicated for individual health needs. Consult a physician also for recommended exposure time and temperatures.

   - The Apiary is not liable for any loss, damage, or injury incurred by guests during their stay.

   - Guests are responsible for their own safety and well-being.

   - Use of the amenities offered by The Apiary may only be accessed by guests who are willing to sign this user agreement.

8. Personal Belongings:

   - Guests are responsible for their personal belongings, not liable for any lost or stolen items.

9.  Prevention Policy:

     -Personal bedding, sleeping bags and pillows are NOT permitted. If you suspect you may have come from an environment with bed bug infestation, please let us know so that when you arrive we can assist you to properly heat treat personal belongings and clothing prior to check-in.

     -Regrettably, hostel guests that fall ill with a contagion during a stay will be asked to find other accommodations.

10. Privacy Policy:

   - The Provider respects guests' privacy and will not disclose personal information to third parties without consent.

   - Managers at times may need access to the facility, when feasible guests will receive prior notice in non-emergent situations.

11. Commercial Use Insurance Requirement:

      Any commercial use of this facility requires guest providers to carry their own Liability Business Insurance and provide proof of insurance (general liability insurance of at least $500,000 per occurrence and $1,000,000 in the aggregate) with a binder for The Apiary, Hormetic Healing LLC, and CNB Properties for the time period operating out of The Apiary.

12. Governing Law:

   - This Agreement shall be governed by and construed in accordance with the laws of the State of Alaska. By making a reservation and/or staying at The Apiary, the Guest agrees to abide by the terms and conditions set forth in this Agreement and respect all house rules.

The Guest shall indemnify, save harmless and defend The Apiary/HormeticHealing LLC and CNB Properties LLC , their officers, agents and employees from liability of any nature or kind, including cost and expenses, for or on account of any and all legal actions or claims of any character whatsoever resulting from injuries or damages sustained by any person or persons or property as a result of any error, omission or negligent act of the Guest relating to the use of the facility or it’s amenities.
